Your legal obligations as a landlord
Landlord registration - Part 8 of the Antisocial Behaviour (Scotland) Act 2004 requires all private landlords in Scotland to register with their local authority. The purpose of this is to make sure that all landlords meet minimum standards and to allow tenants to identify landlords of private rented properties. There is a one-off application fee of £55.00 per owner. Thereafter, each additional property registered is subject to a fee of £11.00. A discount of 10% is applicable to online applications. Owners of HMO properties are only required to pay £11.00 fee in respect of any licensed HMO properties they may own. Gas Safety - All gas appliances and pipe work must have a Landlord’s Gas Safety Check carried out by a Gas Safe registered plumber. It must be carried out within 12 months of the installation of a new appliance and annually thereafter. All records of any safety checks must be kept for 2 years and copies of certificates issued to the tenant within 28 days of the check being completed and issued to any new tenants before moving in. Under the Housing (Scotland) Act 2014 there must be "satisfactory provision for giving warning if carbon monoxide is present in a concentration hazardous to health". This means that it is mandatory for private landlords to install CO detectors where there is a gas boiler or other gas appliance within the rented out property.
Every property will be covered by GasSure, a boiler maintenance place which covers boiler breakdowns, parts and labour charges, call out costs and one Gas Safety Certificate per year. The landlord will be responsible for the annual charge of £179.88.
Electrical Appliance and Fixed Wiring Inspections - • At the start of each new tenancy, and at least once every five years during the court of the tenancy, an Electrical Inspection Condition Report (EICR) and a Portable Appliance Test (PAT) must be obtained and these tests must be carried out by a qualified and accredited electrician. The cost of the EICR and PAT test will be subject to a survey and quotations will be approved before any works are instructed.
Energy Performance Certificate - All landlords are required to provide prospective tenants with an Energy Performance Certificate (EPC) for their property. The EPC will allow prospective tenants to calculate approximately how much electricity and gas a property will require in order to better predict potential running costs.
The cost of the EPC will be £75.00 + VAT
Smoke Alarms- Under the Housing (Scotland) Act 2014 there must be:
One functioning smoke alarm in every room which is frequently used by the occupants for general daytime living purposes;
One functioning smoke alarm in every circulation space, such as hallways and landings;
One heat alarm in every kitchen;
All alarms must be integrated.
The cost will be subject to a survey and quotations will be approved before any work is instructed.
Repairing standard - The Housing (Scotland) Act 2006 requires landlords to ensure that the property meets the Repairing Standard. In order for Repairing Standard:
It must be wind and water tight and reasonably fit for human habitation;
The structure and exterior of the house (including drains, gutters and external pipes) must be in reasonable repair and proper working order;
The installations in the house for the supply of water, gas and electricity and for sanitation, space heating and heating water must be in reasonable repair and proper working order;
Any fixtures, fittings and appliances provided under the tenancy must be in reasonable repair and proper working order;
Any furnishings provided under the tenancy must be capable of being used safely for the purpose for which they are designed; and
There must be satisfactory provision of smoke alarms.
